1. Acceptance of Terms

By downloading, installing, activating, or using the ApexMouse software application ("Software") or accessing the website (apexmouse.tech), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Software.

2. License Grants & Tiers

Subject to your compliance with these Terms and payment of applicable fees, ApexMouse grants you a non-exclusive, non-transferable (except as expressly permitted herein), worldwide license to use the Software as follows:

3. Device Activation, Transfers & Offline Grace

Our licensing infrastructure operates via Gumroad's secure licensing API:

• Device Binding & Activation Limits: When activated, the Software verifies against your Gumroad license key. ApexMouse Pro permits activation on up to 2 personal Macs, and Power Bundle permits up to 5 Macs. Reinstallations on the same Mac preserve activation credentials via the macOS Keychain.
• Moving to a New Mac & Resetting Slots: If you reach your machine activation limit, you can contact us via our Support & Reset Request Form or email apexmousesupport@gmail.com to reset your activation count immediately.
• Offline Functionality: After online activation, ApexMouse functions 100% offline for up to 15 days before requiring a brief internet ping to re-confirm license validity.

4. Permitted Use & Restrictions

You agree to use the Software in accordance with all applicable local, national, and international laws. You agree NOT to:

• Decompile, disassemble, reverse engineer, or attempt to derive the source code of the compiled binary, except to the extent permitted by applicable law.
• Distribute, sell, lease, sublicense, or publicly host license keys, bypass keys, or unauthorized cracks of the Software.
• Bypass, alter, or circumvent the cryptographic licensing validation mechanisms or Gumroad API endpoints.
• Use the Software in any manner that impairs, overburdens, or damages our infrastructure.

5. Merchant of Record & Financial Transactions

Our order process and merchant of record is Gumroad, Inc. Gumroad handles payment processing, invoicing, currency conversion, chargebacks, and sales tax/VAT compliance. All purchase transactions are subject to Gumroad's Terms of Service and Customer Policies.

6. 14-Day Money-Back Guarantee

We proudly offer a 14-day no-questions-asked money-back guarantee on all direct license purchases. If you are unsatisfied with ApexMouse for any reason within 14 calendar days of your purchase date, contact us or Gumroad for a prompt 100% refund.

7. Intellectual Property Rights

The Software, including its code structure, algorithms (such as CVDisplayLink deceleration curves, magnetic drop shelf physics, and semantic region detection), brand name, logos, graphics, and documentation, are the exclusive intellectual property of ApexMouse and its creators. All rights not expressly granted to you under these Terms are reserved.

8. System Compatibility & Requirements

ApexMouse is compiled as a Universal 2 binary supporting both Apple Silicon (ARM64: M1/M2/M3/M4) and Intel (x86_64) architectures. The Software requires macOS 14.0 Sonoma, macOS 15.0 Sequoia, or later. While we strive for forward compatibility with future macOS releases, we cannot guarantee operation on unsupported or beta operating system versions.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. APEXMOUSE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL APEXMOUSE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA LOSS, OR SYSTEM INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE. IN ANY CASE, APEXMOUSE'S AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE LICENSE.

11. Termination

These Terms remain in effect until terminated. Your rights under this license terminate automatically without notice if you fail to comply with any provision of these Terms, or upon issuance of a full refund or chargeback. Upon termination, you must cease all use of the Software and uninstall it from your devices.
